Adoption: Adoption is the formal
procedure to take a person into one's family and raise as one's own.
An adult may be adopted without the consent of a natural parent or parents
or any other person, except that a married person not legally
separated from their spouse may not adopt or be adopted without the
consent of their spouse. Minors may be adopted by adults at least
ten years older than the child, and if the child is over the age of 14,
consent of the child is necessary. Termination of natural parental
rights is generally necessary in order for an adoption to take place. Premarital Agreements: Such an agreement is between prospective spouses in contemplation of marriage. This agreement becomes effective upon marriage. It is enforceable without consideration, but must be in writing and signed by both parties. Property Division: Nevada is a community property state, but the property rights of husband and wife may be altered by a premarital agreement or a marriage contract or property settlement. Such written agreements may affect the properties, the tax obligations and the rights between spouses. Custody Agreement: Nevada has adopted the Uniform Act for Custody of Children, and the terms of any such agreement are subject to approval or rejection by an appropriate court upon presentation in an appropriate situation. |
